About these terms
These terms are the Terms of Service and the Terms of Use for Lets Link LLC, doing business as MJL Collective (“MJL Collective,” “we,” or “us”), a New Jersey limited liability company that designs, builds, hosts, and maintains websites for small businesses.
Part A covers anyone who uses our website at https://mjlcollective.com. Part B covers clients who hire us and use the client portal. Part C covers text message alerts. Part D applies to everything. By using the website or our services, you agree to these terms.
If you and MJL Collective sign a proposal, quote, or agreement for a project, that document controls where it differs from these terms.
A1. Terms of Use: using the website
You may browse the website and use its contact form for personal or business purposes. Please do not misuse it. That means no attempts to break in, overload, scrape at scale, or interfere with the site; no sending spam, malware, or unlawful content through the contact form; and no pretending to be someone else.
A2. Our content
The text, design, images, logos, and code on this website belong to MJL Collective or to the clients and partners who let us show their work. You may share links and short quotes. You may not copy, resell, or reuse the content or the design without written permission.
Client names, logos, and screenshots shown in our portfolio belong to those clients. Showing them does not mean they endorse anything beyond the work we did for them.
A3. Links to other sites
The website links to client sites and other sites we do not control. We are not responsible for their content, availability, or privacy practices.
A4. Website provided as is
We work to keep the website accurate and online, but it is provided “as is” and “as available.” Information on it is general and is not a quote or an offer. Prices and scope are set only in a written proposal or agreement.
B1. Terms of Service: our services
We provide website design, development, content, hosting, maintenance, and related services. The scope, deliverables, timeline, and price of each project are set in a written proposal, quote, or agreement that you accept, by signature, email, or payment. Work outside that scope is a change request and may be priced separately. We will tell you before extra charges apply.
You agree to give us the content, access, approvals, and feedback we need in a reasonable time. Delays on your side can move the timeline.
B2. Payments
Fees, deposits, and payment schedules are set in your proposal or agreement. Unless it says otherwise, invoices are due on receipt, deposits are non-refundable once work has started, and recurring hosting and maintenance plans are billed in advance and renew until cancelled. Payments are processed by our payment provider (currently Stripe), and we do not store full card numbers.
If a payment is more than 15 days late, we may pause work, pause hosting or maintenance, or withhold final files until the account is current. We will give you notice by email before doing so.
B3. Client portal accounts
Clients can sign in to the client portal at https://www.mjlcollective.com/clients to send change requests, ask questions, and see project updates. Keep your sign-in details private and tell us right away if you think someone else has used your account. You are responsible for activity under your account. Only invite people to your account who are allowed to act for your business.
We may suspend portal access if an account is misused or put at risk. We may also close an account after a project ends and any hosting or maintenance plan has been cancelled.
B4. Ownership of deliverables
You keep ownership of everything you give us, such as your logo, text, photos, and brand materials. You confirm you have the right to let us use them for your project.
Once you have paid in full for a project, you own the final, client-specific deliverables we made for you, such as the finished site design, written copy, and graphics created only for you. Until then, we keep ownership and give you a license to use them for review.
We keep ownership of our pre-existing and general tools, code, templates, components, and know-how that we use across projects. You get a permanent, non-exclusive license to use them as part of your finished site. Third-party items such as fonts, stock images, plugins, and software stay under their own licenses.
Unless you tell us otherwise in writing, we may show the finished work and your name and logo in our portfolio and on this website.
B5. Hosting and maintenance
If we host or maintain your site, we will use reliable providers and take reasonable care to keep it secure, backed up, and online. We do not promise uninterrupted service. Outages at hosting, domain, email, or other providers are outside our control. Domain names are registered in your name, or transferred to you on request once your account is paid up.
If you leave a hosting or maintenance plan, we will help you move your site and files to a new host within a reasonable time, once all invoices are paid. Larger migrations may be quoted separately.
B6. Your responsibilities
You are responsible for the content you ask us to publish, and for making sure it is accurate and lawful. That includes your own legal pages, licenses, and industry rules. We are not your lawyer or accountant, and nothing we build or write is legal advice.
B7. Termination
Either side can end a project or plan with written notice by email. If a project ends early, you pay for work done and costs incurred up to that date, and we deliver the work paid for. Monthly plans can be cancelled with 30 days’ notice and run to the end of the paid period. We may end services right away if you do not pay, misuse our services, or break these terms.
Sections on payments owed, ownership, liability, and governing law continue after these terms end.
Part C. Text message terms
These terms cover text messages (SMS) from Lets Link LLC, doing business as MJL Collective (“MJL Collective,” “we,” or “us”). By turning on text alerts in the MJL Collective client portal, you agree to these terms.
1. Program name
MJL Collective client portal alerts
2. What the program is
MJL Collective builds and maintains websites for its clients. Clients send change requests and questions through the client portal at https://www.mjlcollective.com/clients. When we reply to a request or post an update on your project, we can send you a short text with the start of our reply and a link back to the portal.
These texts are about your projects only. We do not send marketing or promotional texts through this program.
3. How you sign up
Text alerts are off by default. To turn them on, sign in to the client portal, open the Alerts page, check “Text me when MJL replies,” enter your mobile number, and save. You can turn them off on the same page at any time. Consent to receive texts is not a condition of any purchase.
4. How often
Message frequency varies. You get at most one text each time we reply to one of your requests, so how many you get depends on how often we reply.
5. Cost
Message and data rates may apply. We do not charge for texts, but your mobile carrier’s normal rates and plan terms apply.
6. How to stop
Reply STOP to any text to stop getting texts from us. We will send one text to confirm that you are unsubscribed, and then no more. You can also turn text alerts off on the Alerts page. To start again, reply START or turn text alerts back on.
7. How to get help
Reply HELP to any text for help, or email mitchell@mjlcollective.com.
8. Carriers
Wireless carriers are not liable for delayed or undelivered messages. Texts are delivered on a best-effort basis and may be delayed or not delivered for reasons outside our control. Supported carriers may change.
9. Your privacy
We use your mobile number only to send portal project alerts. We never sell it or share it with third parties or affiliates for marketing. See our Privacy Policy for how we handle your information.
D1. Limitation of liability
To the fullest extent the law allows, MJL Collective is not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data, arising from the website or our services. Our total liability for any claim is limited to the amount you paid us for the services involved in the 12 months before the claim, or $100 if you have not paid us anything.
Except as stated in a written agreement, our services and the website are provided without warranties of any kind, express or implied, including fitness for a particular purpose. Some places do not allow these limits, so they may not fully apply to you.
D2. Indemnity
You agree to cover claims, losses, and costs (including reasonable legal fees) that arise from content or materials you give us, or from your breach of these terms.
D3. Governing law
These terms are governed by the laws of the State of New Jersey, without regard to its conflict of laws rules. Any dispute will be handled in the state or federal courts located in New Jersey, and both sides agree to that jurisdiction. Before going to court, we each agree to try to resolve the issue in good faith by email first.
D4. Other terms
If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a term right away, we have not given it up. You may not transfer your rights under these terms without our written consent. These terms, with any proposal or agreement you accept, are the whole agreement between us on this subject.
D5. Changes and contact
We may update these terms. When we do, we will post the new version on this page and change the “Last updated” date.
